‘ASK Andrew’: Cuomo COVID Orphans Launch Series Urging Reporters to Present Key Questions to the Former Governor

BROOKLYN, NY – The Arbeeny brothers, Daniel and Peter, who lost their beloved father Norman in a nursing home, Janice Dean, whose mother-in-law and father-in-law died in a nursing home, and Vivian Zayas and Alexa Rivera from Voices for Seniors, which was born out of the loss of grandparents, parents, siblings, and spouses in nursing homes during the early days of the COVID-19 pandemic, have launched a series in which they will present one of the many still unanswered questions each week for the New York City press corps to ask former Governor Andrew Cuomo, to see if they can get answers. They call the series “ASK Andrew.”
ASK ANDREW #4
“Was NYCRR 415.26 suspended on 3/18/20, or not? If not, why did it need to be reinstated via Executive Order 202.28 on 5/7/20?”
BROOKLYN, NY… The Cuomo COVID Orphans released the latest yet to be answered questions for reporters to ask former Governor Andrew Cuomo. In a recent article, Cuomo stated that “incorrect information… submitted to the federal government… is… the simplest felony to prosecute.”
The Cuomo COVID Nursing Home Orphans said, “We agree.”
Andrew Cuomo testified to Congress and stated in a letter to the DOJ that State Law NYCRR 415.26 was in effect during the period of his deadly March 25th directive. That law states: “Under preexisting New York law, a nursing home in New York State may “accept and retain only those nursing home residents for whom it can provide adequate care.” 10 N.Y.C.R.R. 415.26(i)(1)(ii).”
This week’s ASK ANDREW
1. On March 18, 2020, did Governor Andrew Cuomo’s Executive Order 202.5 suspend NYCRR 415.26, or not?
2. If NYCRR 415.26 was never suspended by Cuomo, as he has stated publicly, why on May 7, 2020 by Executive Order 202.28, did Governor Cuomo reinstate this nursing home law NYCRR 415.26?
